KLRCA Evening Talk Series: Default, Delays, Bias and Fraud: The New Obstacles to Adjudication

This special talk will cover claims for interim payments where the dates for pay less notices have been missed as it could be months or years before the next payment notice; and payment response and jurisdictional issues arising therefrom and some aspects of fraud and bias.

Speakers Profile

Justice Peter Coulson QC (Judge of the High Court, Queen’s Bench Division)

Justice Coulson was a member of Keating Chambers, one of the two specialist construction sets, from 1984, and took Silk in 2001. He is a Bencher of Gray’s Inn. He was appointed as a Senior Circuit Judge in the TCC in 2004 and became a High Court Judge in 2007. He is the author of Coulson on Construction Adjudication, The Technology and Construction Court and of the chapter on architects, engineers and quantity surveyors in Professional Negligence and Liability. He is currently Presiding Judge of the North Eastern Circuit.

Ivan Loo (Partner, Skrine & Co)

Ivan graduated from the University of Bristol, United Kingdom and thereafter called to the Bar of England and Wales (Gray’s Inn). In 1992, he was admitted as an Advocate & Solicitor of the High Court of Malaya. He is a Partner in the Malaysian law firm of Skrine where he heads the Construction and Engineering Practice Group. He is currently the President of the Society of Construction Law (Malaysia), Vice President of the Malaysian Society of Adjudicators, a Fellow of the Chartered Institute of Arbitrators (UK) and a committee member of the Arbitration and Alternative Dispute Resolution Committee of the Bar Council, Malaysia. A significant portion of his past and present work involves the construction industry where he appears primarily as lead counsel in arbitration and/or litigation proceedings and also in the drafting and reviewing of construction related contracts. Ivan also sits as arbitrator in both international and domestic arbitrations and is on the panel of arbitrators of the Kuala Lumpur Regional Centre for Arbitration. He is also an accredited mediator with the Malaysian Mediation Centre.
